Bankruptcy Forms (England) Question.

Background, I need to declare bankruptcy. I am unemployed. I live with my parents in their home. I have few assets Car, TV and Hifi. My debts are unsecured, Loan and credit cards.

I have located a Statement of affairs (debtor's Petition) Form 6.28.

The form asks do I have use of another motor vehicle?

I am a named driver on my dads Insurance does this count ?

Why are the asking as I don't own the car ?

It then goes on to ask how much do other members of your household contribute each month to the household expenses.

I don't know what my parents income is (one retired one working part time) It's not the kind of question they would answer even if I asked.

It then ask for the total Household income.

The Name and ages of all occupants of your household and if they are dependant on you.

Are they trying to involve my parents in my debt ?

A crossed blank cheque dated 30-04-2002 was given to a firm. The cheque was presented on 03-08-2002 for collection in the bank but it was dishonoured due to insufficient funds. The accused has not got any notice/summon till July, 2007 from the firm or concerned court.

Recently a summon (u/s 138 and 142 Indian Penal Code) from the court is sent to accused. In this notice/summon they are claiming- that a notice dated 08-08-2002 was sent by the complainant to the respondent within 15 days of the receipt of the dishonored cheque. The respondent failed to make the payment to the complainant within the stipulated period of 15 days, therefore the present complaint is being filed in the court within one month of the expiry of the said stipulated period of 15 days.

Please advise that what is the legal position of the accused in this case?

I shall feel highly obliged if you please guide me on the following matter.

I gave a blank post dated cheque dated 30-04-2002 to a company against the supply of goods. But company supplied the goods were not as I had ordered for. When I complained, the company supplied the ordered goods. I paid Rs. 10,000 on 16-05-2002 by cash. I requested many times the company to collect the goods they supplied wrongly earlier and the balance payment of the goods. But company did not care at all. The company presented that cheque filling total amount i.e. the wrong goods and the ordered goods to their banker. Due to insufficient fund my banker returned the cheque on 03-08-2002.

Now in July 2007, I have received a summon from the court of dishonour of cheque u/s 138 and 142, the company has claimed –

- that a notice dated 08-08-2002 was sent by the complainant to the respondent within 15 days of the receipt of the dishonored cheque. The respondent failed to make the payment to the complainant within the stipulated period of 15 days, therefore the present complaint is being failed in the court within one month of the expiry of the said stipulated period of 15 days.

But I have not received any notice/summon (except this one in July 2007) during these long five years of period either from the company or the court.

I would like to request you to please tell me about my position, what should I do against the charges labeled upon me and how can I defend myself in this legal frame.

One more thing I would like to clear that, since my 2002 company is declared (not legally) bankrupt as no business is done (deposit and withdrawal) so far will this issue play any role in favour of me or not.

If I make $35,000.00 dollars a year at my job, and my pay is directly deposited into my checking account, I assume I will be paying taxes on my income. Just from a basic stand point, if I'm 30yrs old, what would I pay in federal income tax, looking at this in terms of some percent? Does a person pay 5%, 10%, 20% on their ordinary income throughout a year? Overall, what I am looking for is comparing a couple of scenarios. I am comparing a tax sheltered annuity VS. investing money in something other than a "tax sheltered annuity". I know that an annuity is "tax deferred", and investing money at a local bank, into a CD or a mutual fund, is not "tax deferred". If the bank is offering some interest rate, say 5.5%, and I know this is not growing "tax deferred" I want to be able to compare an interest rate of 5.5% and the fact that I invested $5,000.00 over 5yrs in a CD, to a slightly lower interest rate, yet the money is invested in an annuity over the same five year period. The reasoning is that the annuity is growing "tax deferred". I figure if I knew how much money would be coming out each year in taxes if I choose to invest in the CD rather than the annuity, I could make some kind of initial mathematical decision. If I invest $5,000.00, and in one year it grows to $6,000.00, with the CD what percent would I loose to taxes in just that year?

I had trouble with a credit card company at least 20 years ago, they refused to work with me and turned me into a collection agency, I had no dealings for at least 20 years, but every so often I get a letter from a collection agency wanting to settle for a reduced amount (according to their records which where trumped up in the first place).
