The company I work for holds a staff lottery which is drawn at the end of every month. On 27 June 2008, at 12.20 I received an e-mail from the communications department to say I had won £1,000 on this months lottery. At 17.06 I received a phone call on my mobile phone to say there had been a mistake, I hadn't won the money and the e-mail had been sent to the wrong Jean. How do I stand on this matter?

I work for royal mail on a five day a week 20 hour contract but I have a six day a week round my contract also states that my hours of work are between 10am and 12pm but I never start or finish at these times. Is this lawful? also I have been applying for 40 hour contracts with royal mail eight times in total but I never get them because of there seniority policy, is this against the new age discrimination at work laws and can this give me good grounds for constructive dismissal?

Promoted in Oct 07, I now find my employer unwilling to pay my FTE wage even though I have it in black and white stating my pro rata and FTE. My boss and the director signed the promotion form with the FTE stated on it unfortunately HR had not updated the payroll software to reflect the fact I have been F/T for the past two years. Initially HR said they apply a 6% uplift on promotion which they still have not clarified where this figure comes from, my boss then said there was no money in the budget, then at my 1st stage Grievance he said I will pay you what I deem the job to be worth not the FTE. The chair of the grievance failed to make a ruling? Where do I stand legally

My employer currently pays all employees monthly by BACS. Due to financial difficulties I have had to close my bank account and all the banks that I have tried have refused to let me open even a basic account with them (I am NOT bankrupt nor have I committed fraud). I have arranged with my niece to have my wages paid into and my mortgage paid from, her spare bank account but my employer is refusing to pay my wages into any account not in my name. Obviously I do not have an account and despite explaining my situation they insist on sending me a cheque which they expect me to cash at one of these cheque cashing places. Are they allowed to refuse to pay my money into an account of my choice?

I had six days leave booked at the end of February and am now on garden leave from my employer which started on the 5th February and ceases on the 29th February. I have written to my employer on the 6th February to cancel those six days. My employer in turn has told me its to late to cancel that leave. I have also been told that I am not entitled to take up paid employment during the period of garden leave, nor am I entitled to return to work. This leaves a shortfall of 6 days pay for the months of February. Does my employer have the right to refuse my cancellation of the holiday and deduct the 6 days pay? I get paid monthly and have been working there for 18 months.

I have just recovered from a major operation and was off work longer than expected due to complications. 2 April - 20 August 2007. The companies salary increase was 3.25% in July 2007. I was informed verbally that if I was off work for more than 58 days - I would have to make up the time before being eligible for the salary increase. However I have since heard that I will not get it at all! I cannot find anything in the staff handbook concerning this and I asked over a week ago for them to tell me where I can find this 'rule' as they call it in the staff handbook. I have not had a reply. If this is correct I will not be able to make up the increase and will always be 3.25% behind my colleagues? I probably am the most dedicated and work extra hours. whilst I was on sick leave, I dealt with my emails everyday and made sure before I left the office in April that all my work was done for the following months.

I am in a situation at work (I work in a hotel bar) where I am being asked to personally pay for some drinks a resident charged onto a room bill as they claimed they didn't buy them. The resident in question was inebriated and I am most certainly not negligent as I asked to see the room key and did before charging the drinks onto that bill. Is there a law preventing hotels from taking money from their staff in this instance? kind regards S Allen

Dr David Sellings
I am intending to launch a recruitment website (Jobs4Oldies.com) that, while available to all, would cater to those people seeking gainful employment after their primary career has drawn to a close (essentially a euphemism for those typically over 50 years of age). We have received a great deal of support and interests from potentially interested parties in the concept, however, concerns have been raised by a legal establishment we approached regarding possible conflicts with the 2006 UK Employment Equality (Age) Regulations. Conversely, other legal and pseudo-legal agencies (including ACAS) have stated it is a ‘grey area.’ As ‘Oldies’ ourselves, we believed that by catering for mature and experienced people, we were fully embracing and endorsing the ethos of the Act - preventing older people being discriminated against in the jobs market because of age. Indeed, the raison d’etre of Jobs4Oldies.com is to facilitate the employment of older workers by providing recruiters with access to a pool of mature and experienced job seekers through a single Internet vehicle. Any view would be greatly appreciated.

A company is merging with another company. The senior management structures of company A is not being changed. Managers in company B are being slotted into the structure at company A. Where there is no obvious slotting in post, competition will apply and those unsuccessful will be redundant. Should the managers at company A also be at risk and required to be considered or apply for posts? What if the senior managers at company B were experienced and qualified enough to do the senior manager post at company A which are not being changed? Could this be unfair dismissal for someone in company B?

UK LAW As a result of central government cut backs the Child Monitoring Agency (CMA) has to make a number of redundancies in staffing levels. I, a female Asian senior administrative officer has been selected for redundancy on the basis of a Last in First Out (LIFO) agreement, which had been negotiated with the trade unions. I have worked for the CMA since 2005. Given the changes in legislation and the obligation to develop race awareness the CMA has changed its recruitment policy and a recent employee profile showed that 30% of new recruits were women and 22% of new recruits were from ethnic minority backgrounds. I am the most recent recruit in my department and grade and in one of 20 people overall who has been selected for redundancy. I am concerned that I have been selected for redundancy and want to know on what basis. I think I have a good case to take to an Employment Tribunal and intend to submit a claim to an Employment Tribunal. The CMA intends to resist the claim relying on the fact that this was an agreed procedure of the trade union. Advise me as to my rights and to any possible claim(s) I could make and on what basis; and what rights and responsibilities the CMA may have.
