I have a 7 month old son, his father is married. I used to live in NC and I was not doing very well, I had no job and living with others, my brother friends etc. after my son was born my mom told me of the many opportunities there are for me in NY. My sons father didn't do much for us in NC so I thought it would be a good idea for us to move to NYC. He was upset about it but knew I had to do what I had to. Now he found out that I am seeing someone else and I think that he might want to try to take him away from me. He has not contributed in anyway. Since my son has been born he brought him 4 outfits and sent $35.00. I don't have any objections to him seeing his son, but what can I do to make sure that he doesn't take my son away from me?

My husbands ex wife had a child in Nevada, they were not together at the time of birth and we are not sure of paternity. The ex filed for divorce and child support while my husband was in jail (she put him there). We has asked for paternity test and been denied by the mother. The state of Nevad said that as long as you are legally married at the time of birth then you are the father. We have been paying child support thru the court system. Mother has taken child to Michigan and still refuses DNA testing. How can we make her comply to prove that my husband is not the father. If he is the father than he would like to have visitation, but from a womans point of view I don't think he is the father. We women are to rude not to throw it someones face if he were the father.

My fiance had sex with this girl a couple of time and she got pregnant. I told him to get a DNA test done just to be sure. He was there at the hospital when the baby was born. She lied to him saying that they couldn't do the test right away and that he needed to sign the birth certificate so she could leave the hospital. I have helped him take care of the baby and I noticed that the baby doesn't look anything like him or her. So we got a DNA test and it wasn't his baby. The problem now is she is trying to get him for child support and when he went into court over it the judge said that he had 30 days to get his name off after the baby was born but we didn't know then. The judge said that the only way he could get out of this is if she has someone adopt the baby. Is there any other way to get his name off that birth certificate?

What is the punishment in OH for falsifying information on a police report? What is needed to prove the information is erroneous, and how do you go about reporting this to the authorities and requesting an inquiry so the person can be further investigated and information can be verified? Is it difficult to prove and have them prosecuted?? I need this to happen IMMEDIATELY for a custody case/domestic violence case/aggravated menacing and threats case in Summit County OH, and I have 2 witnesses (1 has given a written statement, the other is a minor child) to the fact the information has been falsified. When I was married I went through a lot of mental abuse and emotional abuse and so when we got divorced I wanted it over quickly and went ahead and let him have physical custody of the kids just because I was scared to fight him. Well, I moved back home to Florida. He was out of the military trying to get back in and from what I heard with no such luck. Then one day he gets a letter from them giving him orders to go to Iraq. Well, I told him that I would like the kids while he was gone. He basically told me no and gave them to his grandmother without my permission. We both have legal custody and I think he shouldn't have been able to do that. Well, I moved back to Nevada so that I could be near the kids, but I want them in my home so much. How can I go about getting them with me?

This is in the state of Nevada.

My husband of almost 20 years left 3 years ago to PA and was ordered by Florida to pay $271 a month as of 6/1/2007, which includes back support for those three years. Our daughter is 17 and had a baby and he wants to stop payments. He has only paid one. She will be 18 in May, however, she is debating on living in CA with the father of the baby and her dad doesn't want to pay another dime. Is there a way, if I sign a paper with the court, that even if she lives in CA and I live in Florida, that she can still collect the money owed to her, as she is going to need it? I don't want it for myself and it is only a couple more months until she is 18.

This one is a hard one. I am newly married father of an eight year old girl (not with child’s mother). My child’s mother and I since April 2006 have legal joint custody but she has the right to live with mom. We have a good relationship so child support has never been an issue and my child has stayed with me and my family and gone to school by my mother’s house since she was born. My child’s mother has four children (total includes my child) all girls each a different father. Now July 2007 due to another man she is now living in a domestic violence women’s shelter. She has my child living in that shelter and entered some program for help but my child’s mental status is not well because of this situation, she does not want to be there either. Her mother says now in this program my daughter can not sleep over until she is out of this program. I am able to see her during the day and on weekends but I do not want my child there. What are my options to remove my daughter from this situation? I live in New York and so does the mom. Would I be able to get sole custody if I take her to court? Can I take her to court and save my daughter even though she is in the women’s shelter program? Please help with all options available. Thank you

Hi, I live in Texas, my daughter who is 11yrs and has been living with me for 8 months. Before that she lived 2 weeks with her father and 2 weeks with me, but as she got older it did not work out. We have never been to court and I want to file for sole custody and child support (starting from this month and forward), he currently gives me $80 a month. We both work with good jobs. My question is can he file on me for back child support? She lived with him for 3 years from 1998 to 2001? Thanks!!!

I am asking this here because I don't know what to do, My grown daughter and her boyfriend have a 5 yr old daughter. They live like absolute slobs. The house is totally filthy to the point of unhealthy. The smell is unbearable. I have tried threatening my daughter with the fact that if someone from child services saw the place the kid would be taken. They do not otherwise mistreat the kid. I take her to my house whenever possible to get her out of that disgusting place. Since I said that to my daughter a few years ago, things are only worse. No one cleans anything. There is trash and old food all over the place. The other day, when I was there picking up my granddaughter, I was looking for her clothing. (yes, you have to look for it) and I came across some paperwork written by her boyfriend, (child's father) that was basically a profile on me, and it stated that he thought I was trying to take his daughter away from them, then further down the paper it said

Sentence: 'death' and went on to say that he was going to move them out of state but he would "implement his plan before he left". I have not said anything to my daughter yet. I believe this 29 yr old "supposed" man is whacked. He has not worked in five years, and is a fan of animated cartoons. With somewhat of this background explained, I need to know, if I turn them in to child services due to the living conditions, what would happen to my granddaughter? and if she was taken from the home, what would be the chances of having her placed with me? and should I go to the police about what he wrote? I have the copies. (yes I took them). I also fail to see how my own daughter who was not raised like this can stay with him knowing he has written this stuff about me, and how she can live like they live?

Hope this made some sense. I am after all - confused and depressed over this whole situation.

in Texas--is child support 20% of net income-even if you have legal custody of the child 40% of the time? mom has 4 days-dad has 3 days of each week-dad (my son) is paying approx. 20% of his net income plus health insurance and 50% of uncovered medical expenses.. Hi, I would really love some help with my query. Here goes...

In 2000 a married woman who was five months pregnant left the US and moved to New Zealand to follow a man she had been having an affair with. Her husband was unable to locate her. She committed bigamy be remarrying. Four months later her son was born , with the second husband thinking he was the biological dad. He was unaware she was married when he met her. Now the woman has died and the first husband and biological father of the child has traced the childs whereabouts through a death notice placed in her old home town. As the child was born to US citizens abroad he could have become a US citizen although papers were never filed for that. Can the first husband put through papers to have the child made a US citizen and file for custody? Or does the case have to be heard in New Zealand? Thanks.

Please help. My sister has a fiance who is disabled due to a stroke. He is in a nursing home and cannot speak, walk etc and is paralysed on the left side for 5 months now, His only family, mother sister live in Chicago, My sister lives in Mich. His Mother is trying to get him to Chicago with her to get his SSI checks. He and my sister have lived together for 17 years and never married. She has been giving authorization for his care as needed and now the nursing home is saying she has to get Guardianship of him or marry him. What do you suggest she do to keep her fiance in Michigan? Doctors say he cannot be transported due to his illness and his mother is elderly. I know it would cost to have him transferred by ambulance to Chicago and the mother wont be able to afford the costs but my sister is desperate at this point. Could you give me the best advice. My sister who has total custody of my nephew is willing to sign over custody to my husband and I as is his biological father too, although he does not have custody per the divorce decree in Florida.

The problem is, my husband and I live in Ohio, My nephew and sister live in Minnesota but the divorce and custody agreement were done in Florida.

Ohio is telling me that I may have to file for custody in Florida, But they have moved from Florida a good 3-5 years ago. Does Florida still have jurisdiction over this?!?

I get free legal services through my husbands employer, they are not returning my phone calls.

Another lawyer is helping out but I am just curious as to what info I can get regarding custody involving 3 separate states.

I might mention also that my nephew is 15 going to be 16 in a few months and that ALL parties involved are in full cooperation and agreeable to the custody switch.

I need help A.S.A.P! Any information on what to do would be greatly appreciated.

We have our 13 year old grandson living with us because of his behavioral problems and neither parent are willing to have him in their homes. He is on probation at this time for a year because of what happened when he lived with his mother. The court put him in our home for that year. Parents have joint custody and can't even talk to each other. Father keeps insurance on child and supposedly pays $200.00 a month. Mother says father isn't paying. Father says he is. Mother says she can't afford to pay anything. Mother sees child once a month. We don't know what either does. If there is an issue of money owed to a Dr. neither one wants to deal with it. We have asked to adopt him on paper so we can draw social security and be able to keep insurance on him and they wouldn't have to worry about it. Or we consider taking them to court and getting custody of him and have the court decide what parents should do. Either way we want our grandson to respect his parents and see them but we feel things are really out of our control when it comes to the care of our grandchild. We don't want to be vindictive about this, our grandchild loves his parents and so do we.
