Negligent misstatement

Please help, this is a uni assignment, I need a few experts to give me advise on this.

Amy is an accountant who works for a large firm of city accountants, AST. At a social gathering with clients, she meets a personal assistant, Bertie, who works for a client. Keen to make an impression, so that Bertie might ask her for a date, Amy tells him all about a company, PD, that is about to be listed on the stock exchange. She tells Bertie that she believes PD is a " Bad cart" investment. Bertie takes her advice, only to lose a large amount of money as the share price falls dramatically a week later listing.

Amy had prepared the audited accounts for PD that were published on listing. They contained a financial error in respect of intellectual property capital (which was valued at $5 million, whereas the true figure was $2million). This was due to Amy's failure to comply with accepted accounting procedures. When the error becomes public knowledge, a week after listing , PD's share price falls substantially.

Having read the accounts on the first day of trading, ZCT Ltd (a minority shareholder) decides to launch a take over bid by buying more shares. A week after completion of the deal the share price falls, causing ZCT,Ltd substantial losses.

Diana, a keen amateur investor, reads the audited accounts, obtained from Companies House. She also reads the company prospectus. Diana invests £5,000 on the first day. She losses half her investment by the beginning of the second week

Advise Bertie, ZCT and Diana.

The European Community enacts Directive 01/222 on 1 January 2006 (fictitious) that gives the rights to male employees to claim a one-month period of paternity leave after their partners have given birth. The United Kingdom has announced that they will not be bound by that directive as a 2005 Fathers Rights Act (fictitious) provides for paternity leave of 2 weeks; any more time, the UK claims, would be unnecessary and detrimental to British companies.

Four friends, whose partners happen to be pregnant, ask you to act as their solicitor. Andrew works for the Department for Environment, Food and Rural Affairs. Joshua, an Indian citizen, works for Uxbridge Council. Joshua is married to Christine, a French citizen who is unemployed but was looking for work before she got pregnant. Robert also works for Uxbridge Council. Finally, Simon, an Italian, works for Barclays Bank.

Christine gets really annoyed with the decision of Uxbridge Council not to give her husband one month’s paternity leave. She discusses her feelings with Joshua and the angrier they get, the more radical options they come up with; eventually, they decide to set the Uxbridge Council building on fire ‘in order to teach them a lesson’. The police arrest both of them and they are now worried in case they are deported.

Advise Andrew, Joshua, Christine, Robert and Simon on their rights

Miss yvonne scott
I work for a hotel in Columbus Ohio. At the end of every shift we are to count the drawer and make a drop, leaving the drawer with $250.00. I did so last week and left my drawer $0.08 over. After close of shift I had not touched the drawer. When 2nd shift came in and counted the drawer it was $20.00 short. My manager told me that he was going to take it from my pay. I asked him to check the cameras and my paper work and my drop. He did so and found nothing but is still taking it out of my check. I am not the only one that has access to the drawer. It is never locked so anyone has access to it. I am not the only this has happened to. I was not told at hire date that if our drawer was short that it would be deducted from our pay, nor did I sign anything agreeing to such an action. Is this legal?

This premises is a hairdresser’s shop and has recently been bought by Dotty. She intended to open immediately but on the day she took possession this proved impossible because the vendors had taken the seating and hair dryers which had all been securely bolted to the floor. They have also taken the mature potted palm trees and antique wooden bench from the entrance to the shop. She had intended to use this seating for waiting customers. Dotty went to an auction and bought some new chairs but the auctioneer has since telephoned her to say the original owner was his grandmother who has changed her mind and wants the chairs back.

Dotty had tried to begin clearing the back garden but this also proved impossible because her new neighbour Oscar flew a model aeroplane in circles above her head. Oscar occasionally took a break from flying his model aeroplane and then took to firing air-gun pellets at Dotty’s dog.

Dotty arranges for Electricks, a local company to provide a quote on re-wiring the premises. Gus, an employee of Electricks attends with Bert. He leaves a quote for the proposed work with Dotty it includes the statement that:

‘Electricks will only accept liability for electrical defects arising within the 2 month period following the contractual completion date.’

During the course of their inspection Gus finds a gold necklace which he keeps. The necklace is worth some $50,000 and the following people all believe they are entitled to it: Gus, Bert, Electricks, Dotty and the wife of the previous owner of the house.

Both Minnie and Tom and two other students (Jack and Jim ) share this house. They are also members of a rock band and usually play in the student bar each Friday night. Last Friday another student told Jim that his guitar playing was dreadful and that the Martin guitar he was playing was stolen from his friend Stan, who really knew how to play. He showed Jim a photo of Stan playing the Martin guitar.

Jack has aspirations to be a writer. He frequently talks to Gilbert, the oldest person on the street, and has written down many of Gilbert’s life stories. He would like to publish the stories in a book but Minnie has told him he cannot do this as the copyright belongs to Gilbert. Some time ago Jack went to a local television station and told a producer there of his idea for a television series on a group of students living in a house. Jack suggested that a TV camera be set up just to watch what happened. The producer told Jack it was a stupid idea but has now gone on to launch a very successful series based on Jack’s idea.
