My house was repossessed in Oct 2007, at the time of repossession there was an outstanding mortgage, and 2 loans of some £25,000 each, my ex partner with whom I owned the house filed and went bankrupt in march 2007, the repossession and sale of the house cleared the mortgage, but not the two loans, I now have the creditors coming after me for, £27,000 and £28,000, my question is am I liable for the whole amount or is half of each loan down to my ex partner as both loans were in joint name and does her bankruptcy wipe out both loans her part (if liable) or does she still need to pay half, many thanks

We had a visit from Building Regulations (Scotland) and have been told we must have two toilets. There is no space for an additional one though. Our business is a small cafe and florist, all within the same unit. The size of the shop is less than 30 square metres and will only seat maximum of 28 people at any one time. Do we have any options?

I own 2 houses with a piece of land, and the only access is via a large grass verge, owned by a housing association. They have given permission to build a driveway over the verge, however it has a covenant on the verge saying they are not permitted to do anything with it. How do I get this lifted?

I live in a housing association house as an assured tenant and have done so for 15 years, it is a 2 bed property. I have 2 sons 25 and 17 and I am getting married next year and will be moving into my future husband's house as it is necessary for his work and my home is too small. The question is: will it be possible for my son who will be 18 next year ) , to take over the tenancy? It has always remained in my name and not passed over . My 25 year old son will be getting his own home, so it's not possible for him to share with his brother. Can you advise me? thank you

I purchased my council house property 18 months ago. However I have since met a partner and would like to move in with him, therefore leasing my ex council property. There is a clause in my contract of purchase that indicates whilst I was given a discount, if I move within 5 years I must repay back the difference I was given for the number of years I did not remain within the five year bracket. Is there a similar clause for leasing, and I am within my rights to lease at any point within these 5 years without occurring any forfeits with regards to paying back the discount? Do I also have to change my mortgage to a buy to let? or can I remain with my current mortgage? Kind Regards Jo

My husband and I have separated. We are now trying to sell the marital home. Whilst waiting for it to sell I have moved into rented accommodation and he remains in the marital home. I am paying over £300 pcm for a 1 bed flat whilst he pays £420 mortgage on a 3 bed house, which is far less than he would pay to rent a property of similar size. Whilst I am happy with the arrangement I need to know am I by law still entitled to half the profit from the sale or could he argue that I moved out and have not been paying the mortgage?

I have just received a law society lease (unregistered), it was agreed I would have three months free rent due to the state of the property, the rent is paid quarterly but they have put the first payment date as the 24th June yet I have not signed anything as yet, is it usual to back date rent to when the offer was put in on the property?

I have recently got myself into financial difficulties and borrowed money against the property I live in with my husband. He was unaware of this. The property is registered in my name only and, although I have my debts under control, my husband wants assurance and security of knowing that I cannot borrow any more money without him knowing. There is no mortgage on the property but there is a secured loan with the Halifax which has another 10 years to run. To have his name put on the Deeds means having the secured loan put in our joint names, which I am not happy to do. Can I register my husband as having a charge on the property instead? I know that I need to complete Land Registry form CH1 but do I need a solicitor as well or can I spare the expense of this (as money is tight under the current circumstances)?

I am having great difficulties with my private landlord and one issue in particular. On signing the lease it was agreed (verbally and through the letting agent that has since been sacked by the landlord) that damaged flooring was to be replaced prior to my moving into the apartment and monies were withheld by the landlord from the previous tenant’s deposit as he had caused the damage. Six months later this work has not been done and I have been told by the landlord that it will not be done. As monies were held specifically for this work does this not mean that the landlord had to carry out the work?

The letting agents for a flat I vacated nearly two years ago are going to take me & my guarantor to the small claims court for money they say I still owe them. They have provided us with the papers they are submitting to the court and have said they are claiming double the amount owed by adding interest at a rate of 8% per annum for the two years they say the money has been owed and adding other charges. They have cited some housing act that they say permits them to so this. They didn't contact me about this until 10 months ago so can I be charged interest for a supposed debt that I knew nothing about for 13 months of the two years? I do not trust that the amount the agents say I owe is accurate and I was willing to risk going to court to dispute this until I was told about these extra charges. They have sent two sets of accounts that differ in the amounts that they say I paid during the tenancy. I'm wondering if these interest charges can be added on legally. Before I was issued with these papers I was told by a housing solicitor that if they take us to court and judgement is made against us that we would only have to pay the court costs on top of the money I'm supposed to owe. These costs should be £100 as the amount is under £500. I'm now not sure that the advice I've been given is correct. The agents have also said that a CCJ will be issued against both me and my guarantor.

HIGHWAY/ACCESS DISPUTE WITH NEIGHBOUR: I have a shared access road which i have used since mid 1970s to get to my land where i have got stables garages etc. I used to be able to get hay lorries skip lorries etc up this lane, recently someone bought the land in front of me including lane (which was adopted many years ago before they purchased it).My neighbour has narrowed this access lane preventing me getting lorries up, is he allowed to do this? it also states on my deeds that i can take lorries etc up this lane. My local highway authority was of no help.

My brother and partner are separating and selling their house, he paid 11% deposit and has paid 50% mortgage and bills from his bank account for the past 5yrs, she is now denying him any share in the equity and will only pay him his initial 11%. When he has contacted their solicitor, they have refused to send through copies of paper work and deeds to the property, he has contacted citizens advice, but has only been sent through debt pamphlets! Can you advise where he has rights and what action he should take?

I live in Britain and own 2 properties. We have lived in our main home for 19 years and stay every holiday and weekend in our second home. We do not rent this property out and do not have any lodgers. We are considering selling our second home because I will be retiring next year and we will not be able to run the two properties (my husband is already retired). Will we have to pay Capital Gains Tax? We pay all services on both properties at full rate and we are on the electoral register at both properties.

Hi, please help. We have a garage block for 7 residents, they are all privately owned, we are liable for drainage etc. 1 resident is taking all the front off his garage up with 2/3 year old cars. He works on them and others taking over the block saying he can do what he wants on his bit, access is blocked when he his not there. What can we do? STEVE

I live in Scotland and have discovered that tree roots from a neighbour's garden have damaged land drains which caused flooding. I am concerned that the roots may cause damage to sewers. The trees are 30 to 45 ft high and 30 ft from our house. They now also restrict the sunlight as they are to the east of our house. I am aware that in England the roots could be classed as a legal nuisance. However I am unsure as to the position in Scotland and what rights we have. Ian S Rankin

We bought our newly built property about three years ago. The vendor details stated lawned gardens to front and rear. However, our next door neighbours have erected a fence down the centre of the lawned area and as a result we are left with a border. Do we have any rights even though the boundary line is where they have put the fence.? We no longer have a lawned garden to the front of the property.

Hello, I own a leasehold flat in London which has a low lease term of 73 years remaining. The freeholder/Management company is quoting nearly £25000 for lease renewal up to 150 years. I have written to them on numerous occasions telling them that i require a lease renewal of 99 years so which was the same term originally granted back in 1981 ………………but without much success. My question is ………..can they do this and insist on 150 years instead of 99 years ? If they were to accept 99 years renewal the charge would /should be a lot less hence I believe the reason for their refusal ? please could you advise Thanks M Dad

I previously had a council tenancy then met my ex partner 13years ago & 5 years ago brought our home off the local council with about £20.000 discount due to my tenancy, so when we sell is he entitled to 50% of sale price or 50% of brought cost as there would quite a bit of difference?

Should we take out chancel repairs insurance when buying our new home in Chalford, Gloucestershire? We understand that it can only be levied against church property that was in existence pre reformation. The people who carry out the search on behalf of solicitors are also the people who sell the insurance....hmmm. The search tells you that your area could be liable for chancel rights, but won't tell you the extent of the area, or name any buildings.
