In Oakland, California. Share apt. with two others all month to month with each paying separately to landlord. I am the de-facto "master tenant" though it's not official through the landlord. I have had to replace roommates as ones left in order to keep my part of the apt. One roommate has become a serious problem in that she steals belongings from us/eats our food etc. The landlord is not responding to my calls to find out if that problem roommate is paying her share of rent. She is not paying us her share of household bills. She is currently unemployed. I have told her she has to move out. Gave her verbal notice of a month and tried to get her to sign an agreement to this but she refuses. Now she's refusing to leave and is very angry. I'm afraid she'll do damage to our or the landlords property while we're away at work etc..What can I legally do to get her out ?

My son lives on 10 acres of land that is titled in my name alone. A credit card company through a collection agency filed a lien on my land for a bill that he owes. Is this legal? What should I do to clear this up?

My sister and I along with our mother are on the deed to mother's house. When our mother dies (she won't make a will), will being named on the deed to her house be considered an inheritance or will we have to declare the property as income? Should we try to get her to name us as beneficiaries?

When a relative took in a death certificate and tried to get a house and 38 acres that was to be left to them upon death of the owner (the property was left to the person that went to the recorders office} there is no mortgages on the property, the recorder told them. This has to go through probate because you inherited the land not the house. How can that be?

I paid first and last month rent before moving in to my apartment. I never signed a lease and informed my landlord that I was trying to move to graduate housing in a few months because of the difference in rent. I was unsure if this was going to be available and paid the last month's rent. My landlord informed me that she was leaving the country for awhile. Two days later I found out that I could move and called my landlord's cell phone to inform her of this and to talk to her about the double paid last month's rent. I left a message on her voicemail. After finding out the trip was an entire month, I asked her daughter in law to give her the message. After not hearing back from her, I called my landlord and she's not giving me back the money. Am I legally entitled to it under CA law?

Can a condo trustee "evict" an unreasonable owner? I thought this was laughable when I heard it could be true. How far do the rights of elected condo trustees go in this case? Do they have that kind of power!?

I have a roommate, who I used to be her caregiver, along with being her payee for her ssi disability checks. I want to evict her, as it is no longer working out, and has become a "bad situation" and not a good environment for my 6 yr old son.. what I want to know, if I am her payee, and she has damaged and broke things in my house while she was living here, can I take monies owed for damages from her check?? I have a question about a lien on a house. My boyfriend's house was going to foreclose, so he asked if I could buy the house, so I did. Unfortunately, there was a misunderstanding on my behalf, in which I signed the deed that included him in it. A few months after I bought the house, I tried to refinance and come to find out someone has put a lien on the house because his name was also on the deed. I was told by my mortgage specialist that until he pays the amount he owe, I cannot refinance. But I read on Findlaw that the lien is an expected payment for when you sell the house or when you refinance. The lien was placed after he sold the house to me so they can't expect anything from him and I am unable to refinance because of the lien, so they can't expect anything either. So, is someone lying to me here? He doesn't have the amount they're asking for. He doesn't own the house, since I own the mortgage. We're not married, so what can I really do, except expect him to pay the lien? Thanks!

I own a townhouse that is managed by an association. I moved out of my townhouse for a short time. While I was gone the association claimed they taped notices on my front door informing me of repairs needed to my home. I receive a monthly statement by mail for dues that I pay for my property, when I retrieved this months statement, it shows I am being billed for over $1000.00. I contacted the management company immediately and they recommended that I attend a board meeting scheduled for that night. I attended the meeting and notified the BOD that I had not received the taped notices on my door. One board member commented that it is too expensive to send a "certified letter" so, they tape notices on the homeowners doors. They told me they would make a decision during the executive portion of the meeting (that I was not allowed to attend). The next day I found a noticed taped to the front door of my property stating that they were revoking my reserved parking space and holding me liable of the fees that I have been billed for. I lived out of state and did not receive the initial notices taped to my door therefore I was not aware of the situation. Am I liable for the $1000.00 (+) fees they are charging me? Please help.

My ex-husband and I have property together and we are on the note at the bank for that property together as well. In the divorce decree, I have first option to buy the smaller of the twin homes, however the bank that has the note will not release me from that note because they will not refinance him separately, as he does not make enough money. I cannot afford to make payments on both sides, as we have to split the expenses equally per our divorce decree. I want to purchase one of the town homes, but because he cannot get a loan, I cannot purchase the townhouse because the bank will not release me and will not split the properties. What can I do?

Small claims court am being sued for property damages...need legal advice. A friend offered to let my family live in a vacant mobile home if we paid the monthly lots fees. We agreed to do so. There was not anything in writing at all. When we moved in there was still property of the owner in the trailer and in the storage shed. We were told many times he would come get it. He came a few times and took some things. There was not any inventory of what was there...also there was not a move in condition report..nothing. We cleaned and maintained this home while we lived there. We gave over 30 day verbal notice when we moved out. We were there approx 3+ years...so there was normal wear and tear...but things were damaged and needed cleaning just when we moved in. We are now being sued in small claims court for loss and damage of property. We need advice on how to deal with this. I am afraid the person suing us is fabricating information to get money because he is now being sued by the mobile home park for lot rent when he took the mobile home back and also for damages to property when he moved the mobile home. Do we have any legal rights here?

I was in a roommate situation and I lost my job so I moved out by request of my roommate because I couldn't afford the rent for that month...I gave my room mate $200 at the beginning of the month with a remaining $650 rent... Is it possible for her to take the remaining $450 from the deposit I paid to get the apartment?

I own a piece of property that is not mortgaged. My daughter built a building on the property with my permission. She took out a mortgage on the building before it was built. The building is permanently attached to the land, and is considered "real property" by the local Tax Appraiser. What happens to the building if she fails to pay the mortgage? Can the building be "taken" (as in repossessed) by the mortgage holder, torn down, resold to someone else, or moved? Is the mortgage holders recourse limited to collecting the unpaid amount from my daughter, or do they have other options?

I signed an agreement to purchase a home from someone less the realtors fees since we did not use a realitor. Now they are saying that isnt right and want to go to court if I don't agree to just change this part of the agreement. Can they do that? Get parts of the agreement thrown out without the whole agreement being voided? I am willing to void the agreement totally or I want to stick by the original terms.

I live in a house that is split into two apartments. I live in the upper half and I have three young kids. My neighbor who lives downstairs complains that my kids are too loud and he turns up his music really loud and he pounds on the floor ( his ceiling) to get my kids to quiet down. I have called my landlord a bunch of times, and he won't do anything. And now it is to the point that he will not even answer his phone. What can I do to stop this legally?

Husband deceased 10 years ago this June. We were married in 1986, at which time he had been in the house approx. 1 year, with his sons as beneficiary. My name was never put on the deed, after 11.5 yrs of marriage he unexpectedly passed away. I currently retain widows rights to live in the house, even if I remarry, which I did 3 yrs ago, and we continue to live in the house. Question: Is there a time period that can pass, after which time I could request ownership of the home, if I have been the only one over this 10 year period who paid taxes, provided upkeep and made numerous improvements, all at my expense? Over the past 10 years, taxes have gone up 8 t0 10 thousand dollars each year and I can do nothing about it, even though the house has numerous serious problems. A few years ago my father died and left our family home for my brother and I to share. About 6 months ago my mother had me sign a quick claim deed stating that if social security found out they would take it. I was very sick at the time and living with mother and brother in very scary circumstances. I have MS and stress is a definite thing to avoid with this illness. I guess what I'm saying is that I signed this deed under a great amount of duress. Is there anything that I can do to get "my half" back, as I would like to live in the empty house as it has been my home all of my life.

My father and mother deceased 9 and 7 years. Family home no Will or No Estate filed. Collection says bill is for 5000.00 for a student loan in 1995. Same acct num on bill for CONSUMER LOAN-Home Equity. No student loan taken out in 1995 or ever. Do we inherit this Debt? Home has been paid off. This is a 2nd loan father took out. If the bill says consumer loan-home equity. do we inherit this bill? Can they foreclose on home owned since 1947. 5 siblings and 2 living in home. Brother lost JOB and has not paid in 3 years. Collection statement from lawyers Weltman, weinberg & Reis CO.,L.P.A. asking if an estate has been or will be filed and asking for death certificates. What do we do? Also would like to know how to get family home in siblings name. No other bills just everyday living expenses. No Will. Please help. Thank You

What are the possible penalties for perjury in the State of Illinois? A friend of mine is thinking of lying on an affidavit to obtain sole ownership of a piece of inherited property when it should be shared by a sibling. Could there be any other criminal penalties if his lie were discovered like either attempted theft or fraud? Are any of these possible crimes punishable by imprisonment?

In the year of 1998 Four of us bought a property to be used as a hunting camp. Each of us made equal payments to acquire the property. We established by laws to make equal monthly payments to cover the cost of the insurance, utility bills, and the property taxes. In the by laws we stated and signed to the effect that monthly payments would be made and if anyone was behind in payments of three months they would loose there share of the property. Since then one of our members has passed away and one member did not make any payments for over 10 years. My brother and I have paid all expenses since then, and now my brother and I want to sell the property. The original deed has all of our names on it and the one owner that has not paid his dues will not sign off to have a deed made in my name and my brothers name thus blocks the sale of the property. I have erected a 6ft fence in my front garden which is just inside my garden wall. On the other side of my garden wall is a pavement. I have now been told that I can only go to a height of 1 metre adjoining a highway. Is this correct and where do I stand legally ?
