My mother died in Sept last year 2009. My brother has now died at the age of 42. My mothers will has still not been finalised, but her will stated that her estate should be divided between her remaining children. Does that mean the share my brother would have got had he remained alive now goes to his wife or should it be shared between the remaining children as stated in my mothers will?

hi,

My father has recently died. The only will that can be found is dated in 2004 when he lived with a now ex - partner. wording of will is hold on trust ' x amount of an 100% share to my said partner. Is she still entitled to this even if she now is an ex - partner and they were no longer in contact or living together at the time of his death?

My younger brother instructed solicitors to deal with probate and estate of our late father, against the wishes of myself and older brother (the first named executor). in two e-mails to the solicitor he states he will pay all their costs, the bill is now in at twice the original quote, no offer of remuneration cert and surprise surprise he wants the costs to come out of the estate. Can he be held accountable with his e-mail pledges?

Our grandad has just died and my brother is holding a copy of his will. He is not letting me or his daughter see the will nor is he telling us the solicitors name. He has a copy of the will as he says he took grandad to make the will and he has the only copy. We know we have been left an inheritance. What can we do? thanks.

I have been left a house in my late fathers will, it has a mortgage attached to the property however I am disabled and on benefits and cant have a mortgage, the house has to be sold, but the executive of the will has told me to pay all legal costs to sell the house and all costs like insurance and repairs to the property since my fathers death. Should I be responsible for payments since my Dad died, or should my dads estate be responsible and should I be made to pay the legal costs of selling the house? Even if I cant have a house with a mortgage.

I am in the process of making a Will could you advise as to what happens to 2 properties I own as a joint tenant with a friend in the event of my death and does it count as far as IHT goes. My present understanding is that the properties would go to my friend is that correct and would he have to pay any IHT?

My current will is with my solicitor and it divides my estate between my two children. I now wish to cut one child out of the will. Can I do this legally with a 'DIY' will (the sort that newsagents sell). Would this new will automatically replace the old one and be just as enforceable as the previous one made with my solicitor, or could the 'cut out' child contest it.

My question pertains to a financial matter specifically regarding a Trust Under Will account. Here's the situation. My client's father died in 1973, and his estate was settled with the final step being that his assets were distributed to a Trust Under Will account at a bank with the bank and two others named as trustees. The others named as trustees subsequently resigned leaving the bank as sole trustee. The decedent had stipulated that there be co-trustees on the trust, so the daughter, the income beneficiary of the trust, petitioned to be named as co trustee and it was approved by the bank and her three children, subsequent beneficiaries of the trust. My client, the income beneficiary and co-trustee wants to know if anyone has the power to replace the bank as co-trustee.
